Hello all, We are looking to buy some land and are looking for advice. If you buy terreno rustico can you put a temporary structure on it without planning? Also how is the process and cost to build on land that is already urbanized ? Any advice greatly welcome had a lot of conflictjng information!! TIA

Hi there,

Precise building regulations vary with each camara (council), so visit them before you purchase your chosen plot to see what is possible. My best advice, if you intend to build a permanent house (based our experience), is to get a good architect involved before you do anything - the building regs and licences are complex and make self building/project managing etc tricky.

In terms of cost to build, we gave our architect a budget (€150k for 200 sq metre oveer 2 stories, to a fairly high spec, including underfloor heating and all services, septic tank, solar system etc) and he will deliver the whole project, turn key.

Temporary structures on rustic land are not allowed where we are, but lots of people do it anyway. Again the camara is the place to ask.

The Camara where I live have allowed works to allow the change from a wooden floor to be changed to block and beam due to the wooden floor being rotten.

The roof was taken off and the base for a first floor was laid now we need plans for the completion up to roof level.

The only fee we had was to have materials on the parking area next to the house. We over extended the time and got fined for not increasing the permit time limit.

STRONG advice from someone who has reason to give it :

DO / BUILD NOTHING WHATSOEVER ON YOUR LAND without PRIOR , detailed, PERMISSION IN WRITING FROM THE CÂMARA. Even if the writing is an email, rather than on traditional paper. DO NOTHING WITHOUT PRIOR PERMISSION .

If you do you risk consequences such as being required to demolish / fines etc.. And this is even if your solicitador told you you could do X, Y or Z.

If you want to build stuff on land you are considering purchasing ~make it a condition of purchase that you first obtain the permission in writing from the Câmara that what you wish to do will be permitted. If you do that the Vendor and her/his solicitador may encourage the Câmara to bestir themselves to give the permission.

Some people ~ eg builders who want you to pay them money ~may say things like : ' Oh don't be so northern European worrying about laws and regulations bla bla...........This is Portugal people take no notice.....'

NOT true ( maybe it was in the past ).
